Investigation Across Borders
Cybercrime's defining procedural problem is geography: evidence sits on servers abroad, suspects route traffic through half a dozen countries, and data can vanish in seconds. Domestic law has responded with powers tailored to volatile evidence, including expedited preservation orders, remote search of seized devices, and compelled decryption in some systems, each power contested against rights of privacy and privilege. Internationally, mutual legal assistance treaties are being supplemented by direct production orders served on service providers.
The field continues to widen. States now confront state-sponsored intrusions, attacks on critical infrastructure, and the criminal use of artificial intelligence, while defenders invoke encryption and anonymity that complicate every investigation.
